Financial support for people accepting refugees - amendment to the act

People who have decided to provide safe accommodation to our neighbors fleeing the war can also count on financial support from the government. March 12 this year. the senate adopted a special act on assistance to Ukrainian citizens, which regulates the legality of their stay, financial situation and employment issues. On April 27, the law regulating the previous amendments entered into force. What is the amendment about?

The Amendment Act of April 27, 2022. introduced the following rules:

·       Cash benefit for providing accommodation to Ukrainians, payable for 120 days

After the amendment, any entity, in particular a natural person running a household, who will provide, at his own expense, accommodation and meals to Ukrainian citizens, may be granted a cash benefit on his / her request for no longer than for a period of 120 days from the date of arrival of a Ukrainian citizen on the territory of the Republic of Poland.

The "120 days" rule (according to the original version, the co-financing was due for a period of 60 days) entered into force on April 29, 2022, with effect from February 24, 2022.

In special cases, the benefit payment period may be extended beyond 120 days.

·       A citizen of Ukraine who has been granted accommodation must have a PESEL number

Pursuant to the amending act introduced on April 27, 2022, the refugee using the assistance in the form of accommodation and meals is obliged to have a PESEL number.. In the previous version, the PESEL number or NIP number had to be given to the person who provided this assistance.

IMPORTANT! If the application was submitted before April 30, 2022, the citizen of Ukraine does not need to have a PESEL number because the previous provisions shall apply to applications submitted before the above rule becomes effective. This date is the date of entry into force of the Act of April 27, 2022 "amending the law on assistance to Ukrainian citizens in connection with an armed conflict in the territory of that state."

·       Database for applications for a benefit for providing accommodation to Ukrainians

In order to eliminate fraud and abuses related to granting financial aid for providing accommodation to Ukrainians, the government creates a database. The draft amendment states that:

"The project assumes (...) the collection of data of persons for whom applications referred to in Art. 13 sec. 1 of the Act, which is necessary to monitor the expenditure of public funds on cash benefits for providing accommodation and meals to Ukrainian citizens and to eliminate possible abuses in this respect. Thanks to the implementation of appropriate ICT solutions, the commune authority will be able to determine whether for a given person who has been assigned a PESEL number pursuant to Art. 4 of the Act, no application for funds for the same period has been submitted."

The data is entered into the database by the commune. These are:

  • address of the place of residence of persons admitted for accommodation.
  • name and surname or name of the applicant;
  • name and surname of the person accepted for accommodation and PESEL number;
  • the number of the payment account to which the benefit will be paid;
  • the period for which accommodation was provided and the number of persons admitted to the accommodation;
  • PESEL or NIP number of the applicant;
